Article 8 - Budget
- The budget is an act of HCO’s BoD, which contains the estimated revenues from HCO’s regular and extraordinary resources, as well as the estimated for the year it refers to, along with their justification. Any annual surplus is carried over to the next year.
- The total revenues of the budget are available for the coverage of the total expenses. The allocation of accounts is determined by resolution of HCO’s BoD.
- HCO’s Director submits a report to the BoD every three months regarding the budget’s performance rate and any transfers of estimated amounts from one article or one chapter to another, amounting up to 10% of the total budget. Any transfers beyond this amount are decided by the BoD.
- HCO’s Director prepares and submits to the BoD a budget plan, which is drawn up in accordance with the provisions and the data coming from all HCO’s Departments and is submitted four (4) months before the deadline mentioned in paragraph 6 of this article. The budget plan includes the revenues and expenses, sorted by type and broken down in titles, chapters and articles.
- The following are annexed to the budget plan:
- A report on the course of HCO’s revenues and expenses per year for the next five years, sorted by type and broken down in titles, chapters and articles.
- A plan for HCO’s revenues and expenses per year for the next five years, sorted by type and broken down in titles, chapters and articles.
- A list of the personnel employed by HCO, sorted by category and organizational units.
- A list of HCO’s needs in personnel, accompanied by the corresponding reasons.
- A list of HCO's equipment and real estate with the depreciation value.
- Any suggestions made by HCO’s Director on new investment expenses or improvements are accompanied by the relevant financial feasibility documentation.
- Three months before the end of each calendar year, HCO’ BoD formulates the content of the budget and submits it for approval to the Minister of Culture by October 15th of each year at the latest.
- By resolution of HCO’s BoD, which is submitted to the Minister of Culture for approval, the performance of the budget can be extended for three months both for the collection of the financial year's revenues and for the payment of expenses for obligations undertaken until the end of the year.
- After its approval, the budget can be modified in regard to the allocation of the estimated amounts, in accordance with paragraph 3 of this article.
- If the budget has not been approved by the beginning of the calendar year, HCO’s Director can pay expenses based on the provisions of the last approved budget, up to the amount that corresponds to one third of the approved expenses. The expenses related to personnel wages are paid regularly.
Article 9 - Revenues - Expenses – Management Audit
- The budget revenues are the following:
- The revenues estimated for the financial year the budget refers to.
- The revenues that were not collected in previous years or that are totally prepaid for the coming years.
- HCO’s revenues are collected:
- By HCO’s Treasurer with the issuance of the corresponding receipt from the Accounting Department.
- By the Banks collaborating with HCO.
- HCO’s Treasurer is an employee of HCO’s financial service, appointed by an act of the Director.
- The budget expenses are the expenses estimated for the financial year the budget refers to, without taking into consideration the time when the obligation for payment was created.
- In order for HCO’s expenses to be paid, a payment order, drawn up by the Administration - Financial Department and signed by HCO’s Director, must be issued.
- Without prejudice to keeping the procedures for HCO’s supplies, payments for HCO’s approved activities based on the annual budget, are carried out by HCO’s accountant, without limitation to the payable amount, given that there is a written order by the HCO's Director.
- HCO’s payments are made by bank cheque, payable to the beneficiary, or in cash.
- The persons responsible for the legal and smooth inflow and outflow of money from HCO are HCO’s Treasurer and Director.
- HCO’s supplies of any kind of material (disposable or not) are carried out by order of HCO’s Director, given that HCO's budget includes the corresponding estimation and credit.
- The audit of HCO’s financial management and annual balance sheet is carried out by chartered accountants, who, submit reports to HCO’s BoD, at regular intervals, regarding HCO’s management, as well as a report on the annual balance sheet.
- Within a reasonable time period from the submission of the Chartered Accountants’ reports, HCO’s BoD can order a settlement of the deficiencies, according to their remarks.
- HCO’s Director carries out a semi-annual repressive audit of HCO’s financial management. The results of this audit are submitted to the BoD for its information.
Article 10 - Financial Report- Balance Sheet
- In January of each year, HCO’s BoD prepares the balance sheet with the financial year’s results and the annual report up to December 31st of the previous year.
- Copies of the annual report and the balance sheet are sent to the Chartered Auditors.
- The BoD informs the Minister of Culture in regard to HCO’s balance sheet and annual report by the end of February of each year, at the latest.
- The annual report on HCO’s revenues and expenses depicts the results from the performance of the corresponding year’s budget and presents the following, based on the chart used for the preparation of the budget:
- The estimated revenues and expenses
- The actual revenues and expenses
- The Balance Sheet is prepared in accordance with the applicable legislation and, in general terms, follows the General Accounting Plan.
- HCO’s accounts are sorted in groups and subgroups, depending on each financial activity of HCO.
Article 11 - HCO’s Organizational Structure
- HCO’s services form a Division consisted of the following organizational units (Departments):
- Department of Legislative Coordination
- Department of Information and Seminars
- Administration – Financial Department
- The Division functions under the supervision of HCO’s Director. Its responsibilities are divided among the Departments as follows:
- Department of Legislative Coordination:providence for the implementation of Law 2121/93 and the related international conventions; law preparatory work on matters pertaining to copyright and related rights; preparation of legal studies and publication of related documents; process of HCO's legal cases; representation of Greece before the Instruments of the European Community and the International Organizations on matters pertaining to copyright and related rights.
- Department of Information and Seminars:
collection, sorting and maintenance of documentation material; organization and operation of a library; provision of information on matters pertaining to copyright and related rights; organization of relevant seminars for the purpose of training and informing judges, lawyers, administrative personnel, authors, rightholders of related rights and students.
- Administration - Financial Deprtment:
handling issues regarding HCO's personnel; circulation of mail, typing and reproduction of documents and forms; preparation of HCO’s budget plan, balance sheet and annual report; management of all expenses, settlement of personnel salaries and payments in general, as well as collection of all revenues; providence for the provision of equipment, materials, supplies or other assets and execution of tasks; management of service materials, safeguarding the Organization's facilities and keeping them clean.
Article 12 - Personnel Positions - Qualifications
- HCO has seventeen (17) personnel positions, which are as follows:
- One (1) Director position, as provided in article 5 par. 1 of this presidential decree.
- Two (2) positions for expert scientific personnel, specialized in copyright. The persons that will occupy these positions must possess the qualifications specified in article 25 par. 2 of Law 1943/91 (Official Gazette Α' 50).
- Four (4) positions for persons possessing university degrees in Law. The required qualifications for appointment are a degree in Law from a Greek university or an equivalent degree from another country, as well as excellent knowledge of at least one of the following languages: English, French or German.
- Four (4) positions for persons possessing a university degree in management - economics, one of which positions is that of the Treasurer.
- One (1) position for a Chief Librarian possessing a university degree
- One (1) position for a Librarian possessing a high-school diploma.
- Two (2) positions for computer operators possessing high-school diplomas. The persons that will occupy these positions must possess the qualifications specified in articles 14 and 18 of the Presidential Decree 194/88 (Official Gazette A' 84). In particular, the person that will occupy one of the two positions must also have, as an appointment qualification, excellent knowledge of at least one of the following languages: English, French or German.
- One (1) position for a typist – short hand typist possessing a high-school diploma.
- One (1) position for cleaning personnel possessing elementary school diploma
- For the aforementioned positions that no hiring qualifications are mentioned, apply the qualifications provided by the Presidential Decree 194/88 (Official Gazette A' 84), for the corresponding positions of permanent personnel, as this each time stands.
- In regard to the attestation of excellent knowledge of a foreign language, the provisions of article 5 of the Presidential Decree 172/92 are applied, as this was amended by the Presidential Decree 368/92.
Article 13 - Hiring of Personnel
HCO's personnel will be hired with a contract of private law, for an indefinite or definite period of time, according to the general provisions that apply in each case. The personnel appointment in specific positions is carried out by resolution of HCO's BoD, following the recommendation of HCO’s Director.
Article 14 - Department Supervisors
- The supervisors of HCO’s Departments are appointed by resolution of HCO’s BoD, following a recommendation of HCO’s Director.
- ΤHead of HCO’s Division is the Director. The Director is substituted by the Department Heads, as these are mentioned by order of priority in article 11 of this Presidential Decree.
Article 15 - Beginning of Application
This Presidential Decree will be valid starting from the date it is published in the Official Gazette. The publication and execution of this Presidential Decree is assigned to the Minister of Culture. |
