OPI Operational Framework

copyright law 2121/1993The Hellenic Copyright Organization was founded based on article 69 of Law 2121/1993.

Article 69 of Law 2121/1993: "Foundation of the Hellenic Copyright Organization"

  • A legal entity under private law, located in Athens, under the title “Hellenic Copyright Organization” (OPI) and placed under the supervision of the Ministry of Culture is hereby founded for the purpose of protecting intellectual authors and rightholders of related rights, supervising Collecting Societies, implementing this law and the related international conventions, undertaking law preparatory work on matters pertaining to copyright and related rights and, in general, representing Greece before all competent international organizations and the Instruments of the European Union. OPI can also organize all kinds of seminars for the purpose of providing information and training to judges, lawyers, administrative personnel, authors, rightholders of related rights and students on matters pertaining to copyright and related rights. The purpose of OPI shall in no instance be the collective management of rights, pursuant to articles 54 to 58 of this law.

  • “The Hellenic Copyright Organization is subsidized with 1% of the annual gross revenues of each Collecting Society, paid by October 31st of each year at the latest, based on the balance sheet of the previous year, and collected in accordance with the Public Revenues Collection Code. The annual balance sheets of the Collecting Societies are submitted to the Hellenic Copyright Organization and the Ministry of Culture. This is also applicable to the Collective Protection Societies, which must prepare an annual balance sheet that is submitted to the Hellenic Copyright Organization and the Ministry of Culture. Gross revenues are the revenues as defined by the General Accounting Plan."OPI is also subsidized by international organizations, Instruments of the European Unity, donations, endowments and any other sponsorship by third parties, as well as by the revenues deriving from the provision of services. For the beginning of its operation, OPI is subsidized with a special one-off lump sum from the state budget of the Ministry of Culture amounting to twenty million (20,000,000) drachmas. "The Hellenic Copyright Organization can also be subsidized by the credit accounts of the Ministry of Culture or by the proceeds of the LOTTO and PRO-TO lotteries."

  • A Presidential Decree, issued following the proposal of the Minister of Culture, the Minister to the Prime Minister and the Minister of Finance, defines the object and the specific responsibilities of the Hellenic Copyright Organization within the scope of its purpose, the way and the procedure for exercising these responsibilities, the details regarding the administration and management control of the Hellenic Copyright Organization, the details regarding the personnel and its organization, the amounts of the fees for the provision of services, which can be readjusted from time to time by order of the Minister of Culture and, in general, the way that the scientific, administrative and auxiliary personnel necessary for the staffing of the Hellenic Copyright Organization will be selected, the personnel’s wages and any other relevant detail.

  • The Hellenic Copyright Organization is a public benefit legal entity. The Hellenic Copyright Organization is not part of the public sector; it is not subject to the provisions of public accounting nor the provisions on public commissions and public works or other related provisions. The Hellenic Copyright Organization operates for the public benefit according to the rules of private economy and is governed by private law.

  • The Hellenic Copyright Organization enjoys all the administrative, economic and judicial exemptions, as well as all the procedural and essential privileges of the State

The operation of the Hellenic Copyright Organization is governed by the articles of the Presidential Decree 311/1994 part A' (articles 1 - 7) and part B' (articles 8 - 15).
